CONGRESSIONAL TESTIMONY OF JAMES A. F. KELLY

-CONCERNING FITNESS FOR DUTY The testimony of James A. F. Kelly before the Subcomittee on General Oversight and Investigation may have created the impression that Region IV management is indifferent to fitness-for-duty problems alleged to exist at power plants in the-region. Not only is this not the case, it is not what l

l-Mr. Kelly intended to convey.

The' investigators for the Subcomittee rightly perceived that Mr. Kelly is personally convinced that the current policy of MRC toward fitness for duty, which emphasizes self-policing by the industry, is inadequate for today's j

challenge to nuclear plant safety from societal problems including those steming from the use of drugs and alcohol. At the same time, however, Mr. Kelly realizes that the management of Region IV is bound to implement the l-i current' policy of tha Comission; and that in doing so regional management must

' operate within the limits imposed on its authority to deel with drug and alcohol issues.

Unfortunately, the Subcomittee investigators who were assisting Mr. Kelly in l

the preparation of his testimony were not especially careful to distinguish and implementation of policy and may have inadvertently promoted i
