2 Given the unproven nature of the allegaticns presented by UCS, and the fact that further information is likely to be developed during the investigation, we believe that the Direc-tor's initiation of an investigation is an appropriate response at this time.
- However, in our view, the Director's reasoning does not adequately support his denial of the request for an immediate suspension of construction.
The argument that facility operation is not imminent could be used to deny all petitions for cessation of construction to prevent ques-tionable construction practices.
Accordingly, if the Director's response was the only basis for the denial of UCS request for irmediate action we would probably recommend Commission review.
In this instance, however, staff has also performed a special investigation and found that the alleged problems and deficiencies have been identified by the licensee (or his contractor) or were already receiving the licen-see's (or contractor's) at.ention.
A copy of the inspection report has been sent to UCS.

Further, it appears that the status of construction is such that the identi-fled problem areas can be dealt with before sig-nificant commitments are made.
Under these cir-cumstances, we do not believe the Commission should review the Director's partial denial.

REQUEST FOR ACTION UNDER 10 CFR 2.206 Notice is hereby given that, by petition dated July 21, 1980, the Union of Conce: ned Scientists (UCS) requested that construction at the River Bend Units of the Gulf States Utilities Company be halted.
Allegations of que-tion-able practices relative to plant construction form the basis for the request.
ibis petition is being treated as a request for action under 10 CFR 2.206 of the Commission's regulations and, accordingly, action will be taken on the petition within a reasonable time.
