Dear Administrative Judges:

Under 10 C.F.R. §§ 2.336 and 2.1203, as modified by the Atomic Safety and Licensing Boards November 29, 2017 Initial Scheduling Order, the U.S. Nuclear Regulatory Commission Staff notifies the Board and the parties that the hearing file has been supplemented for this proceeding. On or about July 23, 2019, materials added to the hearing file may be accessed through the Agencywide Documents Access and Management System (ADAMS) and through the Electronic Hearing Docket (EHD). The EHD may be accessed at the following URL:

https://adams.nrc.gov/ehd/. The hearing file is contained in a sub-folder entitled, Seabrook Docket No. 50-443-LA-2 in the Staff Discovery Materials folder of the EHD. An index containing the ADAMS accession number, date, and title or description of each item in added to the hearing file is provided as Attachment 1.

The Staff is adding these documents to the hearing file in an abundance of caution as they are cited in the Staffs Initial Written Statement of Position. Additionally, both documents relate to previously disclosed documents. Specifically, the first document is a letter from the NRC to NextEra dated September 12, 2012, informing NextEra of the deviation from the Reactor Oversight Process (ROP) for Seabrook. The underlying memorandum explaining the deviation from the ROP for Seabrook (ROP Deviation Memo), and attached to the September 12, 2012

R. Spritzer July 23, 2019 N. Trikouros S. Mtingwa letter, was added to the hearing file in the Staffs Initial Disclosures (NRC-00044).1 The second document is a letter from the NRC to NextEra dated September 3, 2013, closing the 2012 Confirmation Action Letter (CAL) and the ROP Deviation Memo. The 2012 CAL was also added to the hearing file in the Staffs Initial Disclosures (NRC-00032).2 Separately, the Staff is providing as supplemental disclosures those documents that it may include as exhibits with its Initial Written Statement of Position but which are not part of the hearing file. An index containing the title or description and location of each item is provided as .

Attached is the affidavit of Justin C. Poole certifying that all materials required to be disclosed pursuant to 10 C.F.R. §§ 2.336 and 2.1203 and the Boards Initial Scheduling Order have been disclosed and that the disclosures are accurate and complete for documents identified as of July 22, 2019.

The Staff notes that it has made a good faith effort to identify and characterize all documents meeting the criteria of 10 C.F.R. §§ 2.336 and 2.1203 in this proceeding. In identifying these documents, the Staff does not concede their relevance to the issues to be decided in this proceeding.
