Letter from NuScale Power, LLC to NRC entitled "NuScale Power, LLC Response to NRC Regulatory Issue Summary 2017-18 , 'Process for Scheduling and Allocating Resources for Fiscal Years 2020 through 2022 for the Review of New Licensing Applications for Light-Water Reactors and Non-Light-Water Reactors ,"' dated February 5, 2018 (ML18036B047)

In the referenced letter, dated February 5, 2018 , NuScale Power, LLC (NuScale) responded to NRC Regulatory Issue Summary (RIS) 2017-18. In part, the subject RIS states that the NRC is seeking new or updated information on schedules for submitting certain applications and on the status of a variety of licensing and design-related activities for Small Modular Reactors (SMR). This response included the status of the design , analyses , testing , licensing , and project planning for the NuScale SMR at that time.

The purpose of this letter is to provide updated planning information regarding future applications to the NRC for the NuScale SMR. NuScale's updated plans include an application for a standard design approval. The scope of this application is planned to include a revised Final Safety Analysis report (FSAR), consistent with the scope of Part 2 Tier 2 of the NuScale Design Certification Application (DCA), and the associated changes to topical and technical reports addressing updates to the NuScale plant design.

NuScale plans for pre-application to focus on FSAR content and to obtain NRC agreement with the proposed approach. One goal of pre-application engagement is to achieve a more efficient review, of about 24 months. Efficiencies in review will be supported by: 1) eliminating extraneous detail from the current FSAR, using risk insights where appropriate; and 2) marking the FSAR to distinguish between changes that clearly require NRC re-review, and changes that do not automatically require re-review on the basis of 10 CFR 50.59 criteria. In addition , NuScale plans to revisit risk-informed initiatives that were discontinued for the purpose of maintaining schedule during the DCA. For example , defining "credible" in terms of risk. Such a definition would bring clarity and consistency to the review, and would allow NuScale to benefit from the safety of its design.

NuScale is currently planning to use the application process under 10 CFR Part 52 Subpart E, Standard Design Approval. NuScale requests the NRC to initiate a project number for this application process. NuScale intends to submit an application in second quarter calendar year 2021 , and is planning to initiate pre-application meetings with the NRC in the third quarter of 2019.
