RESPONSE TO NUSCALE POWER, LLC LETTER ON SUBMITTAL OF PLANNED STANDARD DESIGN APPROVAL APPLICATION CONTENT Thank you for your letter of February 24, 2020 (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML20055E565), regarding your plan to submit an application for NuScale Standard Design Approval (SDA) that includes a request for approval of content not specifically required by Title 10 of the Code of Federal Regulations Part 52, Subpart E. You stated that this additional content would help facilitate the incorporation of the NuScale SDA into subsequent licensing applications (i.e., 10 CFR Part 52 Subpart C-Combined Licenses). Additionally, you requested U. S. Nuclear Regulatory Commissions (NRCs) feedback on the planned SDA application content to ensure alignment in the early stages of the applications development.

As discussed with you during a public meeting on January 30, 2020 (ADAMS Accession No. ML20072M798), the staff did not identify any apparent concerns with an application that contains information beyond what is specifically called out in the regulation as long as it is applicable to the major portion of the standard design for which NRC staff approval is sought.

However, it is important to note that the staff does not review and/or approve an applicants plan for future application submittal. The final determination on the acceptability of the content of the application cannot be made until the application is formally submitted to the NRC and an acceptance review is performed.
