Dear Mr. Bergman:

The Commission has received your letter dated December 14, 2018, concerning the NuScale Power, LLC request to revisit and clarify the single failure criterion as it applies to devices that involve mechanical movement but that are considered as having passive single failures in the Chapter 15 safety analysis. The NRC staff is developing a policy paper on this issue for the Commissions deliberation. This is consistent with the staffs established approach of raising policy issues to the Commission that emerge during small modular reactor design certification reviews. Any additional policy issues that the staff may encounter during the review of NuScales application will be addressed through this established process for handling such matters. As discussed in the staffs January 17, 2019 letter (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML19008A270), the staff intends to work to resolve issues in accordance with the overall 42-month schedule.
