Dear Hr. Sanger:

This writing will acknowledge receipt of your Request for Adjudi-catory Hearing with respect to the above-referenced facility. Your Request is being considered in accordance with the regulations of. this Agency. \

Prior to a decision by this Agency concerning a grant or denial of your Request for Adjudicatory Hearing, all contested provisions of the NPDES Permit are stayed in accordance with 40 C.F.R. 5125.35 and.

40 C.F.R. 5125. 36.

It is the understanding of this Agency based on your Request and on personal communication with the staff of the Tennessee Yalley Authority at a meeting held in Atlanta earlier this month, that the cooling towers at the Browns Ferry facility are not performing up to design specifications. moreover, your Request indicates that on July 10; 19?7, subsequent to our Atlanta meeting, one of the towers was taken out of service due to a structural failure and that similar failures remain a real possibility for the other'towers at Browns Ferry.

As the contested provisions of your NPDES Permit have been stayed by the submission of your Request, the temperature limitations contained in the Permit are not currently applicable to the Browns Ferry facility.

However, in accordance with the relief sought in your Request, at any time the ambient upstream temperature exceeds SloF. you will be

expected to comply viith the limits of 90oF. maximum temperature and 5oF. maximum temperature rise, both as measured at the dovin-- .
