Dear Ms. Moser:

We have reviewed the information submitted April 11, 2018, and May 30, 2018, by the U.S.

Nuclear Regulatory Commission (NRC), supporting your request for our concurrence that NRCs approval of ZionSolutions, LLC license termination plan (LTP) for the Zion Nuclear Power Station, Units 1 and 2, may affect, but is not likely to adversely affect the rufa red knot (Calidris canutus rufa), the piping plover (Charadrius melodus), and the northern long-eared bat (Myotis septentrionalis). Based on the information provided, we concur with your "may affect, not likely to adversely affect" determination for the rufa red knot, the piping plover, and the northern long-eared bat.

Please note that your environmental assessment (EA) should indicate that the action area shown in the EA includes designated critical habitat for the piping plover along the Lake Michigan shoreline (areas SU10222, SU10223, and SU10224). Therefore, critical habitat for the piping plover should be added to your species list as a separate listed entity. Your analysis of potential impacts to the piping plover is, however, sufficient to conclude that there will not be adverse modification of critical habitat.

This letter provides comment under the authority of, and in accordance with, the provisions of the National Environmental Policy Act of 1969 (83 Stat. 852, as amended P.L.91-190, 42 U.S.C. 4321 et seq.), the Fish and Wildlife Coordination Act of 1956 (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.).

2 Our concurrence letter concludes informal consultation with the NRC for the approval of ZionSolutions, LLC license termination plan (LTP) for the Zion Nuclear Power Station, Units 1 and 2.
