REFERENCE:

1. Duke Energy letter, Application to Adopt ASME Code Case OMN-20 for Pump and Valve Inservice Testing, dated May 19, 2017 (ADAMS Accession No. ML17139C014).

Ladies and Gentlemen:

In Reference 1, Duke Energy Carolinas, LLC (Duke Energy) requested an alternative pursuant to 10 CFR 50.55a(z)(2) to the testing frequencies in the American Society of Mechanical Engineers (ASME) Operation and Maintenance (OM) Code, by adoption of approved Code Case OMN-20, "Inservice Test Frequency," for the current ten-year Inservice Testing (IST) interval for the McGuire Nuclear Station, Units 1 and 2, H. B. Robinson Steam Electric Plant, Unit 2, and Shearon Harris Nuclear Power Plant, Unit 1.

However, the Nuclear Regulatory Commission (NRC) has recently added to the regulations at 10 CFR 50.55a(b)(3)(x) to allow licensees to implement Code Case OMN-20, for editions and addenda of the AMSE OM Code listed in 10 CFR 50.55a(a)(1)(iv). Therefore, Duke Energy has determined that the alternative requested in Reference 1 is no longer needed. Duke Energy hereby withdraws the subject application to adopt ASME Code Case OMN-20.
