REQUEST TO REVIEW INFORMATION REGARDING SITING CRITERIA FOR THE WESTERN NEW YORK NUCLEAR SERVICE CENTER

Dear Mr. Bembia:

The U.S. Nuclear Regulatory Commission (NRC) received a request to provide the siting criteria for the Western New York Nuclear Service Center during a closed government to government meeting. The NRC staff reviewed Docket No. #050-00201, the docket for the New York State Energy Research and Development Authoritys (NYSERDAs) NRC license, CSF-1, and identified a bound folder of information on this topic marked proprietary.

Before the NRC responds to the requestor, the NRC requests that NYSERDA review the enclosed proprietary information and determine whether the proprietary designation is still appropriate given it is from the early 1960s, and inform the NRC as to NYSERDAs decision regarding whether the information should still remain proprietary.

If NYSERDA determines that any of the information in the enclosure must remain proprietary, then NRC requests that NYSERDA: 1) identify the specific information that is proprietary; 2) provide a request with justification and a signed affidavit that the information contained in the specific document (enclosure) should be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390; and 3) and provide a redacted nonproprietary copy of the enclosure for placement in the NRCs Agencywide Documents and Management Access System (ADAMS) under Docket No. #050-00201. If NYSERDA submits a non-disclosure request, the NRC would review NYSERDAs submittal in accordance with the requirements of 10 CFR 2.390 and would determine whether the information sought to be withheld contains proprietary information and should be withheld from public disclosure.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter without the enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
