CLINTON POWER STATION, UNIT NO. 1 -WITHDRAWAL OF AMENDMENT REQUESTS REGARDING DECOMMISSIONING LICENSING ACTIONS (CAC NOS. MF8224 AND MF8279) (RS-16-153 AND RS-16-143)

Dear Mr. Hanson:

By letter dated December 14, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16349A314), Exelon Generation Company, LLC (Exelon, the licensee) requested withdrawal of three license amendment requests (LARs) related to decommissioning: (1) proposed changes to the administrative controls section of technical specifications (TSs) dated July 28, 2016, (2) proposed changes to the emergency plan dated August 11, 2016, and (3) proposed permanently defueled TSs dated November 17, 2016 (ADAMS Accession No. ML16323A008). The withdrawal of the proposed permanently defueled TS will be handled under a separate correspondence (ADAMS Accession No. ML16354A485).

By letter dated July 28, 2016, as supplemented by letter dated November 4, 2016 (ADAMS Accession No. ML 1621 OA300 and ML16309A013, respectively), Exelon applied for a LAR which would have changed the organization, staffing, and training requirements contained in TS 5.0 after the licensee submitted both certifications in accordance with Title 10 of the Code of Federal Regulations, Sections 50.82(a)(1 )(i) and 50.82(a)(1 )(ii). A copy of the notice of withdrawal of this LAR is provided in Enclosure 1.

In addition, by letter dated August 11, 2016 (ADAMS Accession No. ML16224A895), the licensee applied for a LAR to eliminate the on-shift positions not needed for storage of the spent fuel in the spent fuel pool during the initial decommissioning period and the emergency response organization positions not needed to respond to credible events. Additionally, the licensee proposed to revise the emergency action levels to reflect those conditions applicable when the unit is in a permanently defueled condition. A copy of the notice of withdrawal of this LAR is provided in Enclosure 2.

The NRC has filed the enclosed notices of withdrawal of application for amendment to the facility operating license with the Office of the Federal Register for publication.

Given the previous discussion and by the request of the licensee, the above-cited applications are being treated as withdrawn.

The proposed amendment request would have changed the organization, staffing, and training requirements contained in Section 5.0 of the Technical Specifications after the license no longer authorizes operation of the reactor or placement or retention of fuel in the reactor pressure vessel.

ML 1621 OA300 and ML16309A013, respectively), for a proposed amendment to Facility Operating License No. NPF-62 for the Clinton Power Station, Unit 1, located in DeWitt County, Illinois. The proposed amendment request would have changed the organization, staffing, and training requirements contained in Section 5.0 of the Technical Specifications after the licensee submits both certifications in accordance with Title 10 of the Code of Federal Regulations, Sections 50.82(a)(1 )(i) and 50.82(a)(1 )(ii).

The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration published in the Federal Register on October 11, 2016 (81 FR 70179). However, by letter dated December 14, 2016 (ADAMS Accession No. ML16349A314), the licensee requested to withdraw the proposed amendment.
