CLINTON POWER STATION, UNIT NO. 1; QUAD CITIES NUCLEAR POWER STATION, UNITS 1 AND 2; AND OYSTER CREEK NUCLEAR GENERATING STATION-ACCEPTANCE OF REQUESTED LICENSING ACTION RE: REQUEST FOR EXEMPTION FROM SPECIFIC PROVISIONS IN 10 CFR 73.55(p)(1)(i) AND 73.55(p)(1)(ii) RELATED TO THE SUSPENSION OF SECURITY MEASURES IN AN EMERGENCY OR DURING SEVERE WEATHER (CAC NOS. MF8275, MF8276, MF8277, AND MF8278)
Dear Mr. Hanson:
By letter dated January 7, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML110070507), Exelon Generation Company, LLC (Exelon or the licensee) submitted a certification of permanent cessation of power operations for Oyster Creek Nuclear Generating Station (OCNGS). In this letter, Exelon provided notification to the U.S.
Nuclear Regulatory Commission (NRC) of its intent to permanently cease power operation no later than December 31, 2019, for OCNGS.
By letters dated June 20, 2016 (ADAMS Accession Nos. ML16172A137 and ML16172A151),
the licensee submitted certifications of permanent cessation of power operations for Clinton Power Station, Unit No. 1 (CPS), and Quad Cities Nuclear Power Station (QCNPS), Units 1 and 2, respectively. In these letters, Exelon provided notification to the NRC of its intent to permanently cease power operation by June 1, 2017, for CPS, and June 1, 2018, for QCNPS Units 1 and 2.
After certifications of permanent cessation of power operations and permanent removal of fuel from the reactor vessel for OCNGS, CPS, and QCNPS, Units 1 and 2 are submitted in accordance with Title 1 O of the Code of Federal Regulations (1 O CFR) Sections 50.82(a)(1 )(i) and (ii), the 10 CFR Part 50 license will no longer authorize reactor operation or placement or retention of fuel in the reactor vessel.
By letter dated August 16, 2016 (ADAMS Accession No. ML16229A133), Exelon requested an exemption from 10 CFR 73.55, "Requirements for physical protection of licensed activities in nuclear power reactors against radiological sabotage," Sections 73.55p(1)(i) and (p)(1)(ii) of 10 CFR are related to the suspension of security measures in an emergency or during severe weather for Facility Operating License No. NPF-62 of CPS; for Renewed Facility Operating License Nos. DPR-29 and DPR-30 of QCNPS, Units 1 and 2, respectively; and for Renewed Facility Operating License No. DPR-16, of OCNGS. The proposed exemption would permit a certified fuel handler to suspend security measures in an emergency or during severe weather.
The purpose of this letter is to provide the results of the NRC staff's acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with 10 CFR 73.5, "Specific exemptions," the NRC may, upon application of any interested person or upon its own initiative, grant such exemptions from the requirements of the regulations in this part as it determines are authorized by law and will not endanger life or property or the common defense and security, and are otherwise in the public interest.
The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemption in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.
The NRC staff estimates to complete this licensing action no later than April 4, 2017, with an intermediate request for additional information milestone of December 30, 2016, if needed, and an estimate of approximately 105 man-hours per unit.
