REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR SUSQUEHANNA STEAM ELECTRIC STATION, UNITS 1 AND 2 (TAC NOS. MF4426 AND MF4427)

Dear Mr. Rausch:

By letter dated October 24, 2014, 1 you submitted an affidavit dated October 24, 2014, executed by yourself. In this affidavit, you requested that the information contained in the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (1 0 CFR), Part 2, Section 2.390: to Enclosure of PLA-7245, "Proprietary Version of PPL Susquehanna Response to RAI 1" to Enclosure of PLA-7245, "Proprietary Version of PPL Susquehanna Response to RAI 4 (CD)"

By letter dated November 25, 2014, 2 you submitted an update to Attachment 5 to letter dated October 24, 2014, which correctly marked Attachment 5, and provided the clarification that when combined, Attachments 4 and 5 provide the complete response to RAI 4. In this letter, you referenced the affidavit dated October 24, 2014, executed by yourself. In this affidavit, you requested that the information contained in the following documents be withheld from public disclosure pursuant to 10 CFR 2.390:

Enclosure to PLA-7261, "Updated Attachment 5 to Enclosure of PLA-7245 Proprietary Version of PPL Susquehanna Response to RAI 4 (CD)"

A nonproprietary copy of Attachment 2 to Enclosure of PLA-7245 has been placed in the Nuclear Regulatory Commission's (NRC's) Public Document Room and added to the NRC Library in the Agencywide Documents Access and Management System. Attachment 5 to the enclosure of PLA-7245, and the enclosure to PLA-7261 are withheld in their entirety.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

1 Agencywide Documents Access and Management System (ADAMS) Accession No. ML14311A681.

2 ADAMS Accession No. ML15002A215.

3. The PPL Susquehanna, LLC responses to RAI 1 and RAI 4 contain confidential commercial information, the disclosure of which would adversely affect PPL Susquehanna, LLC.
4. This information has been held in confidence by PPL Susquehanna, LLC. To the extent that PPL Susquehanna, LLC has shared this information with others, it has done so on a confidential basis.
5. PPL Susquehanna, LLC customarily keeps such information in confidence, and there is a rational basis for holding such information in confidence. The information is not available from public sources and could not be gathered readily from other publicly available information.
6. Public disclosure of this information would cause substantial harm to the competitive position of PPL Susquehanna, LLC because such information has significant commercial value to PPL Susquehanna, LLC.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 1 03(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
