SUBJECT: DENIAL OF NON-CITED VIOLATION, NRC REPORT 05000298/2013005-01

Dear Mr. Limpias:

This letter acknowledges your May 20, 2014, correspondence in response to our letter,

dated February 13, 2014. On February 13, 2014, the NRC documented the Cooper Nuclear

Stations failure to promptly identify and correct a condition adverse to quality associated with

the diesel generator fuel oil storage tank vent lines susceptibility to tornado missiles. This

violation was documented as non-cited violation NCV 05000298/2013005-01, Failure to

Promptly Identify and Correct a Condition Adverse to Quality. The non-cited violation enclosed

with Inspection Report 05000298/2013005 (ML14044A105) required you to respond in writing

within 30 days.

On May 22, 2014, the NRC received a letter from you contesting this violation. The NRC is

currently reviewing your basis for contesting the violation in accordance with Part I, Chapter 2,

Section 2.2.8 of the Enforcement Manual. Accordingly, we will provide the results of our

evaluation by written response within 90 days of the receipt of your letter.

In accordance with 10 CFR 2.390, Public Inspections, Exemptions, Requests for Withholding,

of the NRCs Rules of Practice, a copy of this letter will be available electronically for public

inspection in the NRCs Public Document Room or from the Publicly Available Records (PARS)
