CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1AND2, AND CALVERT CLIFFS INDEPENDENT SPENT FUEL STORAGE INSTALLATION-RELAXING OF REQUIREMENT TO CONDUCT FIREARMS BACKGROUND CHECKS CONTAINED IN THE ORDER DESIGNATING AN INTERIM CLASS OF NRC-LICENSED FACILITIES THAT ARE ELIGIBLE TO APPLY TO THE COMMISSION FOR AUTHORIZATION TO USE THE AUTHORITY GRANTED UNDER THE PROVISIONS OF SECTION 161A OF THE ATOMIC ENERGY ACT OF 1954, AS AMENDED (TAC NOS. MF2621 AND MF2622)
Dear Mr. Gellrich:
On June 5, 2013, the U.S. Nuclear Regulatory Commission (NRC) issued Commission Order EA-13-092 (designation order) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13121A459) designating Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2 (Calvert Cliffs), and the Calvert Cliffs Nuclear Power Plant specific license Independent Spent Fuel Storage Installation (ISFSI) as two NRC-licensed facilities that are eligible to apply for Commission authorization to use the preemption authority granted the Commission under Section 161A of the Atomic Energy Act (AEA) of 1954, as amended. As part of the designated class, the licensee is required by the designation order to conduct firearms background checks for its security personnel who require access to weapons at their facility in the performance of their official duties.
In a letter dated August 14, 2013 (ADAMS Accession No. ML13228A265), Constellation Energy Nuclear Group, LLC (CENG), submitted a license amendment request for permission to use Section 161A preemption authority. 1 Exelon Generation, LLC (the licensee}, stated in its letter dated January 23, 2015 (ADAMS Accession No. ML15026A102), that after submitting this request, the Attorney General (AG) for the State of Maryland (MD) concluded that:
... if the NRC authorizes the weapons for use by security personnel at the Calvert Cliffs Nuclear Plant as part of the required security plan, [then] the facility falls within the exemption provided in State law [(the Maryland Firearms Safety Act of 2013)].
1 By Order dated March 24, 2014 (ADAMS Accession No. ML14105A472), the NRC staff ordered the direct transfer of operating authority from Calvert Cliffs, LLC (a subsidiary of GENG), to Exelon Generation, LLC.
Based on the determination made by the MD State AG, the licensee has withdrawn the license amendment request for Calvert Cliffs and the co-located specific license ISFSI to use the preemption authority under Section 161 A of the AEA by letter dated January 23, 2015.
Based on information provided by the licensee regarding the statement from the MD State AG, the NRC concludes that the licensee has demonstrated the requisite good cause and that the requirements of the designation order should be relaxed for Calvert Cliffs and the co-located specific license ISFSI. Therefore, the designation order remains applicable to Calvert Cliffs and the Calvert Cliffs specific license ISFSI, and the requirements of the designation order shall be relaxed so that the licensee is no longer required to conduct firearms background checks as described in Attachment 3 of the designation order for Calvert Cliffs and the co-located specific license ISFSI.
This action relieves Calvert Cliffs and the co-located specific license ISFSI from the requirement to subject all security personnel who require access to firearms in the performance of their official duties to a firearms background check as described in Attachment 3 of the designation order.
