DOW CHEMICAL COMPANY - REVIEW OF THE REVISED EMERGENCY PLAN SUBMITTED JULY 7, 2011, (TAC NO. ME1595)

Dear Dr. OConnor:

As part of your application for renewal of Facility Operating License No. R-108 for the Dow Chemical Company TRIGA Reactor (DTRR), dated April 1, 2009, as supplemented, you submitted your Emergency Plan (EP) for review. On October 11, 2010, you responded to our request for additional information (RAI) regarding the EP, dated September 16, 2010. By letter dated May 24, 2011 and supplemented by letter dated July 7, 2011 you submitted a revised EP that addressed all the RAIs.

We have reviewed the DTRR EP dated July 7, 2011 against the guidance listed below and have determined that the DTRR EP dated July 7, 2011 continues to meet the requirements of Title 10 of the Code of Federal Regulations (10 CFR), Appendix E.
