DOW CHEMICAL COMPANY RETRACTION OF THE POWER UPRATE REQUEST FROM THE DOW CHEMICAL TRIGA RESEARCH REACTOR LICENSE RENEWAL APPLICATION (TAC NO. ME1595)

Dear Dr. Krahenbuhl:

The U.S. Nuclear Regulatory Commission (NRC) received your letter dated January 12, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML110130501), withdrawing your request for a power uprate with your license renewal application (LRA) and requesting the existing power level of 300 kilowatts (kW) for Facility Operating License No. R-108, for the Dow Chemical TRIGA Research Reactor (DTRR).

Because you are no longer requesting a power uprate, the NRC will review your LRA in accordance with the method described in the Interim Staff Guidance (ISG) on the Streamlined Review Process for License Renewal for Research Reactors (ADAMS Accession No. ML092240244).

The NRC requests that you provide an updated safety analysis report, including technical specifications, consistent with a power level of 300 kW. Additionally, we ask you to continue work toward completion of the responses to the request for additional information (RAI) provided in NRC letter dated November 2, 2010 (ADAMS Accession No. ML102700307). However, because the RAIs were written to reflect the power uprate request, a few changes are necessary. RAIs 3, 29.4, 30.2, 44.3, 45.2, 51, 59, and 60 are no longer necessary. Also, the power level referenced in RAIs 13, 15.1, 15.2, 15.3, 18, 19, 24, 26, 30.1. 41, 42, 43 and 67 should be changed from the previously requested uprate power of 750 kW to 300 kW.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 50.30(b), you must execute your response in a signed original document under oath or affirmation. Your response must be submitted in accordance with 10 CFR 50.4, Written Communications. Information included in your response that is considered security, sensitive, or proprietary, that you seek to have withheld from the public, must be marked in accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding.
