NOTICE OF AVAILABILITY OF THE DRAFT PLANT-SPECIFIC SUPPLEMENT 43 TO THE GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS REGARDING PALO VERDE NUCLEAR GENERATING STATION

Dear Ms. Davidson:

The U.S. Nuclear Regulatory Commission (NRC) has prepared the enclosed draft plant-specific Supplement 43 to NUREG-1437, "Generic Environmental Impact Statement for License Renewal of Nuclear Plants" (GElS), regarding the license renewal of Palo Verde Nuclear Generating Station (PVNGS), located in Maricopa County.

In a letter dated June 12, 2009, the NRC requested that the Arizona Game and Fish Department (AGFD) provide lists of State-listed species, and information on proposed and candidate species, as well as any designated critical habitat that may be in the vicinity of PVNGS and its associated transmission line rights-of-way. The AGFD replied to this request on July 16, 2009, and included a list of special status species within five miles of the PVNGS site and special status species within three miles of PVNGS-associated transmission lines.

The NRC staffs assessment of State-protected species is documented in the enclosed draft SEIS and concludes that the continued operation of PVNGS for an additional 20 years is not expected to adversely impact any State-listed species and that impacts to threatened or endangered speCies (both Federally and State-listed) would be SMALL.
