ANNUAL ASSESSMENT LETTER - POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 (05000266/2010001; 05000301/2010001)

Dear Mr. Meyer:

On February 10, 2010, the NRC staff completed its performance review of Point Beach Nuclear Plant, Units 1 and 2. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from January 1 through December 31, 2009.

The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include security information.

A separate letter designated and marked as "Official Use Only -- Security Information" will include the Security Cornerstone review and resultant inspection plan.

Overall, Point Beach Nuclear Plant operated in a manner that preserved public health and safety and fully met all cornerstone objectives. Plant performance for the most recent quarter, as well as for the first three quarters of the assessment cycle, was within the Licensee Response column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at your facility.

In our March 4, 2009, Annual Assessment Letter for 2008 (ADAMS Accession Number ML090630351), we requested that you perform an independent assessment of the corrective actions taken in response to the 2004, 2006, and 2008 independent safety culture surveys referenced in our January 2007 Confirmatory Order EA-06-178 (ML063630336). At that time, we requested this independent assessment because you had exceeded three assessment periods with a substantive cross-cutting issue in human performance and problem identification and resolution, and had seen only nominal improvements in your overall nuclear safety culture assessment conducted in 2008.

Meyer In our September 1, 2009, Mid-Cycle Performance Review letter (ML092440297), we noted that you had completed the requested independent assessment and that the corrective actions you had planned and taken for the 2008 safety culture survey were more effective than those taken for the 2004 and 2006 safety culture surveys and provided reasonable assurance that progress could be sustained. In December 2009, we conducted our final review of actions you have taken in response to the Order. Our review corroborated your independent assessment and we concluded that your continuing focus on safety culture corrective actions will sustain and further improve performance in this area. Finally, we completed our review of your actions required by the Confirmatory Order (EA-06-178) for Point Beach. The results of our review were documented in the fourth quarter 2009 Integrated Inspection Report 05000266/2009005; 05000301/2009005 (ML100410106 and ML100431371).

Additionally, on June 24, 2009, the staff issued a Severity Level III Notice of Violation accordance with the NRC's Enforcement Policy. The violation was discussed in NRC Inspection Report 05000266/2009008; 05000301/2009008 (ML091030350), dated April 8, 2009, and pertained to failing to notify the NRC when licensed operators develop a permanent disability or illness. A follow-up inspection was completed in the third quarter of 2009 with no concerns noted.

The enclosed inspection plan details the inspections, less those related to security, scheduled through June 30, 2011. In addition to the baseline inspections, some infrequently conducted inspections, such as Inspection Procedure 71004, "Power Uprate," are scheduled during this period. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last 9 months of the inspection plan are tentative and may be revised at the mid-cycle review.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS).
