NORTH CAROLINA STATE UNIVERSITY PULSTAR REACTOR -

CLOSURE OF CONFIRMATORY ACTION LETTER NO. NRR-04-010 ON SITE-SPECIFIC COMPENSATORY MEASURES IMPLEMENTATION PLAN

Dear Dr. Hawari:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I acknowledge receipt of your two letters dated January 30, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML090340066 and ML090340067). In your letters, the North Carolina State University (the University) submits that it has met its commitments formalized in NRC Confirmatory Action Letter (CAL) No. NRR-04-010, issued on April 6, 2004 (ADAMS Accession No. ML032580535).

Specifically, the University has provided a January 29, 2009, revision to its March 18, 2004, site-specific compensatory measures (CM) program and has provided revision 11 of its NRC-required security plan which incorporates these revised CM, to be implemented immediately by revision to facility security procedures upon NRC approval of the CM. The revision to the site-specific CM provides details on the implementation of facility changes that were committed to but not completed when the prior revision was submitted; the NRC staff has reviewed the changes and finds them acceptable. Thank you for informing us of this action, which may be examined during a future NRC inspection of your facility. Based on your letter and our previous inspection of your implementation of the compensatory measures, the NRC has found that no further response is required regarding the CAL, and the NRC considers this CAL closed.
