Dear Mr. Edington:

The U.S. Nuclear Regulatory Commission (NRC or the staff) has received your application dated December 11, 2008, and supplemented on April 14, 2009, for the renewal of the Operating License Nos. NPF-41, NPF-51, and NPF-74 for the Palo Verde Nuclear Generating Station, Units 1, 2, and 3 (Palo Verde). On May 15, 2009, the NRC published a Federal Register notice of acceptance for docketing of the license renewal application (LRA).

To improve the efficiency of the environmental and safety reviews, Arizona Public Service Company (APS) and NRC staff discussed the use of an online reference portal that would allow the NRC staff and associated contractors limited read-only access to the basis documents and other reference materials cited in the Palo Verde LRA. The online reference portal will allow the NRC staff to audit basis documents to determine whether the information contained in the documents supports the LRA. The NRC staff will formally request documents to be submitted on the docket, which the staff identify as necessary for its analysis of the LRA or development of the environmental impact statement.

As discussed in your letter dated June 26, 2009, you agreed to the following conditions:

  • The online reference portal will be password-protected, and passwords will be distributed to NRC staff directly involved in the Palo Verde LRA review on a need-to-know basis;
  • The online reference portal will disable any printing, saving, or downloading functions;
  • The online reference portal will be sufficiently secure to prevent staff from printing, saving, or downloading any documents;
  • Staff given password access to the online reference portal will be informed of the conditions of use of the online reference portal by NRC project managers; and
  • The conditions associated with the online reference portal must be maintained throughout the duration of the Palo Verde LRA review process.
