SUBJECT: NRC INSPECTION REPORT NO. 50-188/2008-203
Dear Mr. Whaley:
During the period August 4 to 7, 2008, the U.S. Nuclear Regulatory Commission (NRC)
conducted a security inspection at your Kansas State University TRIGA Mark II Research
Reactor Facility. The inspection included a review of activities authorized for your facility. The
enclosed report presents the results of that inspection.
Based on the results of the inspection, the NRC has determined that a Severity Level IV
violation of NRC requirements occurred. The violation was evaluated in accordance with the
NRC Enforcement Policy. The current Enforcement Policy is located on the NRC=s Web site at
http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. The violation is cited in
the enclosed Notice of Violation (NOV) (Notice) and the circumstances surrounding the violation
are described in detail in the subject inspection report. For administrative purposes, the
enclosed Inspection Report is designated 50-188/2008-203 and the enclosed NOV is
designated as VIO 50-188/2008-203-01.
You are required to respond to this letter and should follow the instructions specified in the
enclosed Notice when preparing your response. The NRC will use your response, in part, to
determine whether further enforcement action is necessary to ensure compliance with
regulatory requirements.
Because this issue involves security-related information, your response will not be made
available electronically for public inspection in the NRC Public Document Room or from the
NRCs document system (ADAMS), accessible from the NRC Web site at
http://www.nrc.gov/reading-rm/adams.html. If Safeguards Information is necessary to provide
an acceptable response, please provide the level of protection described in 10 CFR 73.21.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be
made available electronically for public inspection in the NRC Public Document Room or from
the Publicly Available Records (PARS) component of NRCs document system, ADAMS.
ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the
Public Electronic Reading Room). However, because of the security-related concerns
contained in the enclosures, and in accordance with 10 CFR 2.390 a copy of this letters
enclosures will not be available for public inspection.
