CLARIFICATION OF RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION REGARDING LICENSE AMENDMENT REQUEST FOR APPLICATION OF THE ALTERNATE SOURCE TERM METHODOLOGY (TAC NO. MC6519)

Dear Mr. Crane:

By letter dated March 28, 2005, AmerGen Energy Company, LLC (AmerGen, or the licensee) requested changes to the Facility Operating License for the Oyster Creek Nuclear Generating Station (Oyster Creek). The license amendment request (LAR) would revise the Oyster Creek licensing basis in the area of radiological dose analyses for design-basis accidents using the alternative source terms depicted in Regulatory Guide 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors.

The Nuclear Regulatory Commission (NRC) staff, during review of the submittal, determined that additional information was needed to complete its review. These questions were provided via e-mail in draft form to Mr. David Distel of your staff on November 28, 2006, to ensure that the questions were understandable, the regulatory basis was clear and to determine if the information was previously docketed. Subsequently they were provided in final form by letter dated December 19, 2006. Mr. David Distel of your staff agreed to respond within 45 days from the date of the December 19, 2006 letter (e.g., February 2, 2007).

By letters dated January 24 and February 2, 2007, you provided responses to the questions.

The NRC staff, upon reviewing the responses, identified certain responses that did not fully address the issues raised by the NRC staff in the original RAIs. Specifically, the responses did not sufficiently address use of the assumption of full mixing credit for mixing/dilution in the secondary containment nor the use of a pressure dependant function for containment main steam isolation valve (MSIV) leakage and did not adequately support the offsite atmospheric dispersion factors used to calculate offsite dose. The clarifications needed were communicated to you in teleconferences on February 9, 2007 and March 5, 2007.

In a teleconference on March 15, 2007, you agreed to provide a revised analysis in which full mixing credit and pressure dependant MSIV leakage is not assumed. Additionally, by letter dated March 16, 2007, you provided revised offsite atmospheric dispersion factors for offsite dose calculation.

In order to complete our review of the LAR, the NRC staff requests that you provide these revised analyses. A submittal date of March 23, 2007 was agreed upon during discussions with your staff.
