Motion to Strike - Docket No. 50-219 - AmerGen Energy Company, LLC Members of the Licensing Board, DOCKETED USNRC In accordance with their duties to attempt to resolve claims without the involvement of the Board, AmerGen Energy Company LLC ("AmerGen") and March 23, 2007 (11:12am)
Nuclear Information and Resource Service, Jersey Shore Nuclear Watch, Inc., OFFICE OF SECRETARY Grandmothers, Mothers and More for Energy Safety, New Jersey Public RULEMAKINGS AND Interest Research Group, New Jersey Sierra Club, and New Jersey ADJUDICATIONS STAFF Environmental Federation (collectively "Citizens") have now agreed that Citizens' Reply dated March 13, 2007 was timely. Both parties further Docket No. 50-219-LR agree that although at the time AmerGen filed its Motion to Strike, it had a good faith belief that Citizen's Reply was untimely, this belief was based upon a mutual misunderstanding between the parties. Having discussed the matter further, the parties have now resolved the issue. Thus, AmerGen hereby withdraws the claim of untimeliness contained within the Motion to Strike. Citizens will be filing a response to the remaining argument in the Motion to Strike by March 27.
