ACKNOWLEDGMENT OF DISPUTED VIOLATIONS QUAD CITIES NUCLEAR POWER STATION UNITS 1 AND 2 INSPECTION REPORT 05000254(265)/2006002

Dear Mr. Crane:

This letter acknowledges the letter from Exelon Generation Company, LLC (Exelon) to the NRC, dated August 31, 2006, which provided a response to our inspection report issued on July 31, 2006, concerning activities conducted at your Quad Cities Nuclear Power Station facility. The letter contested two of the Non-Cited Violations (NCVs) contained in the NRC Triennial Fire Protection inspection report, namely NCV 05000254(265)/2006002-01, associated with the safe shutdown makeup pump, and NCV 05000254(265)/2006002-02, associated with residual heat removal service water cross-tie. The letter also stated that, while Exelon did not contest NCV 05000254(265)/2006002-04, associated with the stations fire pre-plans, Exelon does not believe that there is a cross-cutting aspect to the violation because Problem Identification and Resolution was not the underlying cause of the performance deficiency.

We are currently reviewing Exelons basis for contesting the two NCVs, as well as the view that characterizing the third NCV as containing a cross-cutting aspect is not appropriate. The NRC seeks to be thorough and timely in the review of licensees response to NCVs. Accordingly, we will inform you as soon as we complete our evaluation of the Exelon response to our inspection report.
