February 23, 2004 The Honorable Joe Barton, Chairman Subcommittee on Energy and Air Quality Committee on Energy and Commerce United States House of Representatives Washington, D.C. 20515 RE: Connecticut Coalition Against Millstone v. NRC, No. 04-0109 (2d Cir., filed Jan. 6, 2004)

Dear Chairman:

This lawsuit challenges a Commission adjudicatory decision (CLI-03-14) that turned down a request for a hearing in a Millstone license amendment proceeding. The amendment arose out of Millstones effort to revise its technical specifications to take advantage of new source term information. The Licensing Board upheld petitioners standing, but found no admissible contention. On appeal, the Commission affirmed the Licensing Boards decision.

The court of appeals has not yet set a briefing schedule, but the NRCs brief likely will be due in May or June.
