Dear Mr. Lesar:

Virginia Electric and Power Company (Dominion) and Dominion Nuclear Connecticut appreciate the opportunity to provide the following comments on interim enforcement policy regarding enforcement discretion for certain fitness for-duty issues presented in the Federal Register, volume 67, number 211, page 66311 on October 31, 2002.

Dominion recommends that the NRC delay implementation of the change to enforcement policy regarding 10 CFR Part 26 until such time as the policy is consistent with the soon to be released Interim Compensatory Measure (ICM) for access authorization. Since both the enforcement policy and the ICM deal with suitable inquiries they should be consistent and should be implemented concurrently.
