On February 11, 2003, the NRC issued an Order (EA-03-009) establishing interim inspection requirements for the reactor pressure vessel (RPV) head at pressurized water reactors (PWRs). Florida Power & Light Company (FPL), the licensee for the St. Lucie Nuclear Plant, Units 1 and 2, and the Turkey Point Nuclear Plant, Units 3 and 4, and FPL Energy Seabrook, LLC (FPL Energy Seabrook) the licensee for Seabrook Station hereby submit their responses to the Order.

FPL and FPL Energy Seabrook will comply with the Order. Specific relaxation requests will be submitted in accordance with page 11 of the Order Section IV,item F(1) or F(2), as necessary.

Due to the refueling outage for Turkey Point Unit 3 Cycle 20 and the timing of the Order, it was necessary to submit a relaxation request prior to providing a complete response to the Order (Turkey Point letter L-2003 045, dated February 25, 2003). FPL requested relaxation to implement an alternative to the requirements specified in Section IV,paragraph C.(1)(b)(i) or in Section IV, paragraph C.(1)(b)(ii) for the Reactor Vessel Level Monitoring System (RVLMS)Penetrations # 59 and # 60.

FPL and FPL Energy Seabrook could be in the position of having to submit additional relaxation requests during their respective refueling outage inspections. As discussed in the public meeting on Order (EA-03-009) on February 24, 2003, the NRC recognizes that on-the-spot refueling outage relaxation requests will be submitted and are prepared to provide timely responses to such requests.
