On March12,2012,the NuclearRegulatory Commission (NRC)issuedan immediately effectiveorderin the captionedmatterentitledOrderModifying LicenseswithRegardto ReliableSpentFuelPoolInstrumentation (Effectivelmmediately) (Order)lo, interalia, FirstEnergy NuclearOperating Company (FENOC).The Orderstatesthat,as a result of the NRC'sevaluation of the lessonslearned fromtheaccident at Fukushima Dai-ichi in March2011,the NRChaddecidedto directnuclearpowerplantlicensees and construction permitholdersto takecertainactions.Specifically, the NRCis requiring additional defense-in-depth measuresto addressuncertainties associated with protection frombeyond-design-basis events.Withrespectto thisOrder,licensees are specifically directedto providea reliablemeansof remotelymonitoring "wide-range spentfuelpoollevels"to supporteffectiveprioritization of eventmitigation and recovery actionsin the eventof a beyond-design-basis externalevent. Specificrequirements are outlinedin Attachment 2 to the Order.

The Orderrequires submission of an overallintegrated plan,including a description of howcompliance withthe requirements described in Attachment 2 willbe achieved, to the NRCfor reviewby February 28,2013.In addition, the Orderrequires submission of an initialstatusreport60 daysfollowing issuance of thefinalinterimstaff guidance and at six-month intervals following submittalof an overallintegrated planon February28,2013. The Orderstatesthatthe NRCintendsto issuethe interimstaff guidance containing specificdetailson implementation of the requirements of thisOrder

Finally, the Orderrequires fullimplementation of its requirements no laterthantwo refuelingcyclesaftersubmittal of the overallintegrated plan,or December 31,2016,whichever comesfirst.

Pursuantto 10 CFR2.202andthe termsspecifiedin the Order,FENOCherebysubmits its answerto the Order. FENOCconsentsto the Orderanddoesnot requesta hearing.

Basedon information currentlyavailable, FENOChas not identified anycircumstances of the typedescribedin SectionslV.B.1and lV.B.2of the Orderrequiringreliefat this time. In addition,FENOChas not identified any impediments to compliance withthe Orderwithintwo refuelingcyclesaftersubmittalof the overallintegrated plan,or December 31,2016,whichever is earlier.FENOCwillprovidefurtherresponses as requiredby SectionlV.Cin accordance withspecifieddeadlines.However, given the uncertainties associatedwiththe ultimatescopeof requiredworkcausedby the unavailability of implementing guidance untilAugust 2012,andthe impacton the ability of FENOCto complywiththe specific compliance deadline datesbasedon the probable availability of thatguidance, FENOC'sfutureresponses mayincluderequestsfor schedule reliefas warranted by subsequent NRCrequirements or implementing guidance or the resultsof engineering analyses notyet performed. Anysuchrequest wouldbe submittedin accordance withthe relaxation provisionin SectionlV of the Order.
