Dear Sir or Madam:

Pursuant to 1 O CFR 50.90, Entergy Nuclear Operations, Inc. (ENO) requests an amendment to Renewed Facility Operating License Number DPR-59 for the James A. FitzPatrick Nuclear Power Plant (JAF). The proposed amendment would revise the JAF Emergency Plan for the permanently defueled condition.

The proposed changes are being submitted to the NRC for approval prior to implementation, as required under 10 CFR 50.54(q)(4).

The proposed JAF Emergency Plan changes would revise the on-shift staffing and Emergency Response Organization (ERO) staffing.

ENO has reviewed the proposed changes against the planning standards in 10 CFR 50.47(b) and requirements in 10 CFR Part 50, Appendix E and concludes that the standards and requirements will continue to be met. On November 18, 2015, ENO informed the NRC that JAF will permanently cease operations at the projected end of the current fuel cycle, which is expected to occur in late 2016 or early 2017 (Reference 1). Upon docketing of the certifications for permanent cessation of operations (10 CFR 50.82(a)(1)(i))

and permanent removal of fuel from the reactor vessel (10 CFR 50.82(a)(1)(ii)), pursuant to 1OCFR50.82(a)(2), the 10 CFR Part 50 license for JAF will no longer authorize operation of the reactor or emplacement or retention of fuel in the reactor vessel. The proposed changes to the JAF Emergency Plan are commensurate with the reduced spectrum of credible accidents in the permanently defueled condition.

In order to assist in the transition from an operating facility to a permanently defueled facility, the changes are required to properly reflect JAFP-16-0012 Page 2 of 3 the conditions of the facility while continuing to preserve the JAF Decommissioning Trust Fund and maintain the effectiveness of the JAF Emergency Plan. The proposed change has been reviewed by the JAF On-site Safety Review Committee (OSRC). The description and evaluation of the proposed JAF Emergency Plan changes are contained in Attachment

1. Attachment 2 provides a tabular summary of the proposed changes to the JAF Emergency Plan. Attachment 3 provides the revised pages of the JAF Emergency Plan with the proposed changes. Attachment 4 provides the post-shutdown on-shift staffing analysis.

Attachment 5 provides the analysis of ERO tasks that will be transferred to remaining ERO positions.

ENO requests review and approval of the proposed license amendment by December 1, 2016 to allow JAF adequate time to implement changes to the emergency plan and emergency response organization following completion of defueling activities.

Once approved, this amendment shall be implemented within 60 days. ENO requests that the approved amendment become effective upon docketing of the certifications required by 10 CFR 50.82(a)(1

). The proposed changes have been evaluated in accordance with 10 CFR 50.91 (a)(1) using criteria in 10 CFR 50.92(c), and ENO has determined that this change involves no significant hazards consideration.

ENO has also determined that the proposed JAF Emergency Plan changes satisfy the criteria for categorical exclusion in accordance with 1OCFR51.22(c)(9) and do not require an environmental review. Therefore, pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment is required.

In accordance with 10 CFR 50.91(b)(1), a copy of this application, with attachments, is being provided to the designated State of New York official.

Attachment 6 of this letter contains a new regulatory commitment.
