REPORT 2-2014-029, VIRGIL C. SUMMER NUCLEAR PLANT INSPECTION

REPORT 05000395/2015405 AND NOTICE OF VIOLATION

Dear Mr. Gatlin:

This refers to the in-office inspection completed on May 7, 2015, for your Virgil C. Summer Nuclear Plant. The purpose of the inspection was to followup on the investigation, completed January 27, 2015, to review the facts and circumstances associated with a Security-Related issue.

The results of the investigation were discussed on May 7, 2015, with Gregg Douglass and other members of your staff.

This inspection and investigation examined activities conducted under your license as they relate to public health and safety, the common defense and security, and compliance with the Commissions rules and regulations, Orders, and the conditions of your license. Within these areas, the inspection consisted of an examination of selected procedures and representative records, observations of activities, and interviews with personnel.

Based on the results of the inspection and investigation, the U.S. Nuclear Regulatory Commission (NRC) determined that a Severity Level IV Violation of NRC requirements occurred.

The violation was evaluated in accordance with the NRC Enforcement Policy, which is located on the NRCs Web site at http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html.

The violation is documented in the enclosed Notice of Violation (Notice).

The violation is being cited because the non-cited violation criteria of Section 2.3.2 of the NRC Enforcement Policy were not satisfied, as discussed in the Enclosure. For administrative purposes, this letter is issued as Inspection Report (IR) 05000395/2015405, and the Notice of Violation is designated as05000395/2015405-01.

You are required to respond to this letter, and should follow the instructions specified in the enclosed Notice of Violation when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

If you contest the violation or its significance, you should provide a response within 30 days of the date of this IR with the basis for your position, to the Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region II; and the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Resident Inspector at the V. C. Summer Facility.

Please be aware that the material enclosed herein contains Security-Related information protected from public disclosure under Title 10 of the Code of Federal Regulations (10 CFR)

2.390(d)(1), and its disclosure to unauthorized individuals could present a security vulnerability.

If you choose to provide a response and Security-Related information is necessary to provide an acceptable response, please mark your entire response Security-Related Information - Withhold from public disclosure under 10 CFR 2.390, in accordance with 10 CFR 2.390(d)(1), and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
