SUBJECT:

NRC INSPECTION REPORTS 05000395/2009404, AND NRC OFFICE OF INVESTIGATIONS REPORT NO. 2-2008-054

Dear Mr. Archie:

This refers to an investigation completed on December 15, 2008, by the U.S. Nuclear Regulatory Commission=s (NRC) Office of Investigations (OI) at the Virgil C. Summer Nuclear facility. The results of the investigation, including the identification of a finding that was preliminarily determined to be greater than very low security significance (i.e., greater than Green as determined by the Physical Protection Significance Determination Process), and an apparent violation, were transmitted to you in NRC Inspection Report 05000395/2009403, dated July 31, 2009.

At your request, a Regulatory Conference was held on September 22, 2009, to further discuss your views on this issue. During the meeting your staff described your assessment of the significance of the finding, detailed corrective actions, and your root cause determination for the issue.

The enclosure documents a finding that was determined to be greater than very low security significance (i.e., greater than Green as determined by the Physical Protection Significance Determination Process). The deficiency was identified by SCE&G and promptly corrected.

NRC Inspection Report 05000395/2009403, dated July 31, 2009, noted that the uncontrolled Safeguards Information (SGI) represented an apparent violation that potentially affected V. C.

Summers proposed Unit 2 and Unit 3 facilities (Combined Operating License Docket Nos.52-027 and 52-028, respectively). Based on information you provided at the Regulatory Conference, the NRC has elected to not pursue any enforcement against these units and is only citing Unit 1. SCE&G

2 The NRC has concluded that information regarding the reasons for the violation, the corrective actions taken or planned in order to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in the information presented by SCE&G at the conference. Therefore, you are not required to respond to this letter unless the description herein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice.

Because plant performance for this issue has been determined to be in the regulatory response band, we will use the NRC Action Matrix to determine the most appropriate NRC response for this event. We will notify you, by separate correspondence, of that determination.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC=s document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related concerns contained in the enclosures, and in accordance with 10 CFR 2.390, a copy of this letter=s enclosures will not be available for public inspection.
