SUBJECT:

MILLSTONE POWER STATION - NRC PHYSICAL SECURITY BASELINE INSPECTION REPORT NOS. 05000336/2004013 AND 05000423/2004013

Dear Mr. Christian:

On May 6, 2004, the U.S. Nuclear Regulatory Commission (USNRC) completed the onsite portion of an inspection at your Millstone Power Station (MPS). The enclosed report documents the inspection findings, which were discussed on May 6, 2004, with Mr. Alan Price, Site Vice President, Mr. Jeff Campbell, Manager of Protective Services, and other members of your staff.

This inspection examined activities conducted under your licenses as they relate to safety and compliance with the Commissions rules and regulations and with the conditions of your licenses. Within these areas, the inspectors reviewed selected procedures and records, observed activities, and interviewed personnel.

Based on the results of this inspection, the NRC has identified an issue that was evaluated under the risk significance determination process as having very low safety significance (Green). The NRC has also determined that a violation is associated with this issue. This violation is being treated as a Non-Cited Violation (NCV), consistent with Section VI.A of the Enforcement Policy. This NCV is described in the subject inspection report.

If you contest the violation or significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001 and the Resident Inspector at Millstone Power Station. Because this issue involves security-related information, your response will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described Mr. David in 10 CFR 73.21. Otherwise, mark your entire response Proprietary Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.

The material enclosed herewith contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the material will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
