SUBJECT: RESPONSE TO EVALUATION OF A NON-CITED VIOLATION (NRC Integrated

Inspection Report Numbers 05000336/2006006 and 05000423/2006006)

Dear Mr. Price:

Thank you for your letter dated July 12, 2006, in response to NRC Inspection Report

Numbers 05000336/2006006 and 05000423/2006006 dated May 11, 2005. In your response,

you requested further evaluation of a Millstone Unit 3 non-cited violation (NCV)05000423/2006006-04 pertaining to the failure to evaluate and correct conditions adverse to

quality associated with the turbine-driven auxiliary feedwater (TDAFW) pump. Specifically,

although you did not contest this NCV, you provided new information received from the pump

vendor related to the dimensional tolerances of the TDAFW pump stuffing box, information that

was not available as you were finalizing your original evaluation of the problem.

We have completed our review of the information that you have provided in your letter and note

that you indicated that the cause of the problem was not related to your initial assessment of

excessive stuffing box wear. You noted that the stuffing box dimensions were within the

recently provided tolerances from the vendor. The NRC concluded that your request did have

merit because the stuffing box was within vendor tolerances. Thus, we did not include this NCV

when evaluating cross-cutting issues at Millstone during our recent mid-cycle assessment

process. Nonetheless, Millstone did meet the first two criteria of Inspection Manual Chapter (IMC) 0305 for a substantive problem identification and resolution (PI&R) cross-cutting issue as

the result of other findings that occurred during the assessment period. The third criteria,

however, was not met since the NRC did not have a concern with your scope of efforts or

progress in addressing the underlying performance deficiencies.

The new information related to the TDAFW pump stuffing box did not influence the outcome of

our mid-cycle assessment. Therefore, the NRC plans no further action beyond the baseline

inspection program in reviewing this topic. We will continue to evaluate your success in

addressing the IMC 0305 criteria associated with PI&R issues to ensure our confidence in your

progress.
