DETAILS I

On December 16,1992, GPU Nuclear Corporation shipped processed radioactive waste, listed as Radioactive Material - low specific activity, n.o.s. (RSR# 144730), from Three Mile Island Unit 2. Upon receipt at the US Ecology commercial low level radioactive waste disposal site near Richland, Washington, it was determined by an inspection performed by a representative of the Washington Department of Health (see attached letter dated December 29,1992, from the State of l Washington Department of Health) that the measured amount of free standing liquid in one drum j

(#92-D-II-205) of processed waste was 0.72% by volum CFR 61.56 requires that the amount of free standing liquid shall be as little as reasonably achievable but in any case not to exceed 0.5% of the volume of the waste for waste processed to a stable form. Additionally,10 CFR 30.41 requires that the person receiving the byproduct material should be authorized by specific license to receive the waste form. License Condition 30 for the US Ecology Radioactive Material License (State of Washington WN-1019-2) states that solidified waste should contain no more 0.5 % by volume of freestanding liquid. This is an apparent violation of the requirements of 10 CFR 61.56 and 10 CFR 30.41 (50-320/93-02/01).

Mr. J. Schork, Licensing Engineer for Three Mile Island was informed of this aparent violation of NRC requirements in a telephone conversation with Mr. J. Nick of the Region I office on January 26,199 As noted in the December 29,1992, letter from the State of Washington cited above, the licensee was suspended indefinitely from utilizing the US Ecology disposal site by the State of Washington, effective December 24,1992. The suspension is effective until such time that the licensee responds in writing to describe the actions taken or planned to be taken to bring activitics into compliance with applicable state and federal regulations.
