APPENDIX A NOTICE OF VIOLATION GPU Nuclear Corporation Docket No. 50-320 Three Mile Island Unit 2 License No. DPR-73 A violation of NRC requirements was identified as a result of the inspection conducted on December 21,1992 by a representative of the Washington Depanment ofIlealth. The inspection involved a shipment of licensed material sent from your facility on December 16, 1992 to the US Ecology commercial low-level radioactive disposal site. In accordr.nce with the " General Statement of Policy and Procedure for NRC Enforcement Actior.s",10 CFR Pan 2, Appendix C (1992), the violation is listed below:
(A) 10 CFR 61.56(b)(2) states in pan that "... liquid wastes, or wastes containing liquid, must be converted into a fonn that contains as little free standing and noncorrosive liquid as is reasonably achievable, but in no case shall the liquid exceed.. 0.5 % of the volume of the waste for waste processed to a stable form."
(B) 10 CFR 30.41(b)(5) states in pan that "any licensee may transfer byproduct materiai..to any person authorized to receive such byproduct material under tenns cf a specific license issued by...the Commission or an agreement state."
License Condition 30 of the US Ecology Radioactive Materials License, State of Washington WN-1019-2, requires that a waste stream, solidified in accordance with a process control program using an approved solidification medium, contain no detectable free sunding liquid, which is defined as no more than 0.5 % (by volume) of liquid per container.
Contrary to (A) and (B) above, on December 16,1992, the licensee shipped a drum (#92-D-I1-205) containing 1.473 millicuries of waste processed to a stable fonn, which upon receipt at the US Ecology site near Richland, Washington, was detennined to contain a measured amount ofliquid that was in excess of 0.5% b" volume. Specifically, the container was

determined to contain 0.72% fn:e standing liq.d by volume.
