Dear Mr. Hutchinson:

Thank you for your August 11,1997, letter in response to our June 28,1997, letter and Notice of Violation, in your letter you requested that we reconsider our decision regarding Violation 50 313; 368/9715 02. You specifically requested that this Severity LevelIV violation be chLnged to a noncited violation based on the effectiveness of your corrective action process.

Section Vil.B.1 of the NRC Enforcement Policy addresses the use of enforcement discretion for licensee identified Severity LevelIV violations. One of the conditions that is considered is whether the violation could reasonably be expected to have been prevented by the licensee's corrective action for a previous violation or a previous licensee finding. As stated in our inspection report, Entergy had initiated Significant Condition-

Report C 95 0084 in April 1995 for events involving uncontrolled radioactive material, and the majority of the corrective actions for this condition report were completed by the end of 1995. Thus, the NRC concluded that your corrective action associated with the condition report should have precluded the several additional occurrences that were cited in Violation 50 313; -368/9715 02.~ The continued identification of radioactive material items outside a controlled access area indicates that your corrective actions were not effective. Therefore, the use of enforcement discretion would rot be appropriate for Violation 50 313;'368/9715
