Reason for Inspection During the NRC Performance Appraisal Section (PAS) inspection conducted December 7-11, 14-18, 1981, and January 5-7, 1982, a PAS team inspector reviewed the Kewaunee requalification training program for licensed operators. He identified apparent discrepancies between statements on applications for renewal of NRC licenses for two senior reactor operators and one reactor operator. The discrepancies related to the stated status of personnel requalification and the actual status of requalification. These discrepancies involved the 1978-1980 requali-fication program. This observation was discussed with the licensee and was presented to the Senior Resident Inspector (SRI) as a potential enforcement finding.

Findings a.

PAS The findings by the PAS appraisal team indicated the licensee had not complied with the requirements of 10 CFR 55.33(a)(4)

and 10 CFR 55.33 (a)(5).

10 CFR 55.33(a)(4) requires a state-ment by the applicant, that during the effective term of his current license, the applicant has satisfactorily completed the requalification program for the facility for which operator or senior operator license renewal is sought.

10 CFR 55.33(a)(5)

requires evidence that the licensee has discharged his license responsibilities competently and safely.

The Commission may accept as evidence of this a certificate of an authorized repre-sentative of the facility licensee or holder of an authorization

by which the licensee had been employed.

10 CFR 55, Appendix A, i

states, in part, "Section 55.33 of 10 CFR Part 55 requires that

each licensed individual demonstrate his continued competence every two years in order for his license to be renewed. Compe-

tency may be demonstrated, in lieu of reexamination, by satis-j factory completion of a requalification program which has been j

reviewed and approved by the Commission."

Results of the May 2, 1980, annual written examination reveal

!

that three licensed individuals had received grades of-less than 80%, but greater than 70%. Applications for renewal of the individuals' licenses had been submitted as required by 10 CFR 55.33 and were endorsed by the Senior Vice President l

- Power Supply and Engineering. The PAS inspector concluded that requalification requirements of the Operator Requalifica-tion Program were not complete and current when the individuals applied for their license renewals. That conclusion was based

on requirements specified in the Kewaunee Operator Requalification Program (KORP) which had been submitted to NRC o.t April 1, 1981.

The specific requirement of concern states, in part, "An individual

,

receiving an overall grade on the annual written examination of

,

less than 80% shall immediately commence Accelerated Training.

Upon completion of Accelerated Training, the individual shall be i

given a written examination in the demonstrated weak subject areas." The three individuals who had received a grade of less

than 80% on the May 2, 1980, annual examination had not been administered a written examination relative to accelerated training prior to submitting the applications for renewal of license. Therefore, the PAS inspector concluded the statement and certification as required by 10 CFR 55.33 were incorrect.

b.

Region III This followup inspection resulted in the conclusion that the statement and certification were correct and that there were no items of noncompliance or deviations involved. That con-clusion was based on the following:

t (1) The licensee was committed to the KORP which had been reviewed and approved by NRC on July 31, 1978, (Reference P. F. Collins,

NRC, letter to E. W. James, WPSC, dated July 31, 1978).

(2) The program reviewed and approved by the NRC did not require accelerated training unless a grade of less than 70% was i

i attained. The three individuals of concern had each received i

grades of greater than 70% on their 1979 and 1980 annual examinations.

(3) The more stringent passing grade requirements specified in NUREG-0737, Item I.A.2.1, did not become a legally binding NRC requirement until 30 days after the effective date of the ORDER CONFIRMING LICENSEE COMMITMENTS ON POST-TMI RELATED ISSUES issued July 10, 1981.

Exit Meeting The inspector met with licensee representatives on February 5,1982, and discussed the findings of this special inspection.
