Dear Mr. Wadley:

The NRC communicated to your staff on October 9, 1996, that an unreviewed safety question (USQ) associated with post-seismic cooling water system operations existed. This was documented in NRC special inspection report nos. 50-282/9605(DRS) and 50-306/96014(DRS) on November 1, 1996.

Specifically, taking credit for the nonseismic intake canal as a source of water following a seismic event and the implementation of operator actions to reduce nonessential cooling water loads following an earthquake involved a USQ. On January 29, 1997, Northern States Power Company (NSP) submitted a license amendment to resolve the USQ. The NRC sent NSP a. request'for additional information on February 21, 1997, in which we asked that additional l analyses be serformed to seismically qualify the intake canal. NSP is l performing t1e additional analyses, which may take several weeks, and is also considering interim measures in order to resolve the USQ.

Pursuant to NSP's letter dated March 3, 1997, it is our understanding that NSP will take the following action:

NSP will not take Unit 2 beyond hot shutdown (Mode 3) until the NRC staff determines that the USQ has been satisfactorily resolved.

Pursuant to Section 182 of the Atomic Energy Act, 42 U.S.C. 2232, you are required to:

(1) Notify me immediately if your understanding differs from that set forth above; (2) Promptly notify me if for any reason you intend to change or deviate from the commitment discussed above.
