Dear Sir:

Subject: Response to Inspection Report 50-271/90-06, Notice of Violation ->

During a routine unannounced radiological controls inspection conducted on June 18-22, 1990, a violation of NRC requirements was identified. Our response . ,

to this violation is provided below.

VIOLATION

.

Technical Specification 6.5.8 states that " Radiation control standards and procedures shall-be prepared,: approved and maintained and made available to all station personnel. These procedures shall show permissible radiation exposure, and shall be consistent with the' requirements of 10'CFR Part 20. This radiation protection program shall'be organized to meet the requirements of 10 CFR Part 20."

A.~ Radiation procedure, DP 0545, " Fuel Pool Storage Requirements", requires, in part, in Section 2.b that " Items greater than 500 R/hr, but less than L 100,000 R/hr shall be stored on the fuel pool floor, or suspended from the-L~ side of the pool and fastened with a rigid locking mechanism designed to- 1 prevent inadvertent removal of the material."

contrary to the above, on June 19, 1990 the inspector noted several items i: suspended from-the side of the spent fuel pool which were not fastened with a rigid ~ locking mechanism designed to prevent inadvertent removal of the-material. Survey tags on these items indicated exposure rates of up'to 7 20,000 R/hr.

B. Radiation protection procedure AP 0529, " Health Physics Incident Reports",

requires, in part, in Section 1.0 that whenever an individual observes or ,

becomes cognizant of events or conditions such as noncompliance with radiation protection procedures-or requirements, the individual shall ini-tiate a Plant Information Report.

Contary to the above, from February 20, 1990 until June 21, 1990 several personnelsin the radiation protection department ~were aware that several

~

items'were ntored in the spent fuel pool without a rigid locking device.

TheseLindividuals were aware that this was not in accordance with the i req *Jirements of radiation protecton procedure 0545, yet a Plant Information Report had not been initiated. 4 l

'These two examples in the aggregate constitute a' Severity Level IV Violation. (Supplement IV)

RESPONSE Immediately after the deficiency was identified a. Radiation Protection-Incident Report, 90-09, was initiated /dispositioned and the appropriate' locking '

devices were procured. All required locking devices were in place by July 6, 1990. These initiatives put Vermont Yankee in full compliance with existing

procedures.

This situation existed because Vermont Yankee had implemented a procedure

, revision to. strengthen the controls for storing materials in the Spent Fuel Pool. ~ Previous procedur?s.had limited adwinistrative controls to prevent inad- D vertent removal.of a potentially high level source. In an effort to achieve better control of the storage of items in the pool,.the Radiation Protection-

' Department revised the storage procedure, OP 0545. Regrettably, this procedure-revision was issued without ensuring that all revised requirements would be met upon issuance of the procedure. While implementing housekeeping items in-the .i pool, it was found that the locking devices were not installed. -The responsible '

,

supervisor inappropriately concluded that due to the long history of storing the ;

items without a. locking device, an incident report was nott required.. All appropriate personnel are now fully _ aware of the need to generate an incident 1 report.even if the situation involves a pre-existing condition. We believe this to be an isolated instance since our normal practice-is to assure changes are  ;

made prior to implementing a procedure revision. ,
