Another region-based inspector discussed the ~ reporting of significant events with the licensee. The inspection involved 8' inspector hours onsite by two NRC region-based inspectors.

Scope of Inspection . l This inspection was mainly of the licensee's actions in the loading of low specific activity (LSA) radioactive waste on a tractor-trailer so that the radiation level of the underneath surface of the trailer exceeded the 200 mR/hr limit and the radiation level in the cab of tractor exceeded the 2mR/hr limit given in 49 CFR 173.393(j)(2) when

The maximum radiation level in 2ny normally occupied position in the vehicle was 3mR/hr in the sleeping compartment of the cab.

A radiation level of 300 mR/hr was found underneath the trailer.

Radiation surveys were made of the wooden boxes as they were unloaded from the flatbed trailer.

One box, identified as number 16, had maximum radiation levels of about 1R/hr at surface areas of about one square foot on both the top and bottom of the box.

Description of Events Vermont Yankee Nuclear Power Station (Vermont Yankee) specifies that " exclusive use" vehicles are to be used to transport the low specific activity (LSA) radioactive waste from their facility to the disposal site because they wish to package the material in the manner required ' by 49 CFR 173.392(b) and (c) rather than in the manner required by 49 ' CFR 173.392(a).

In early February 1980 Vermont Yankee had 20 wooden boxes containing-low specific activity (LSA) radioactive waste loaded on an open flatbed trailer for transport to the Nuclear Engineering Company, Inc. (NECO) Richland, Washington burial site.

Because the radiation levels at the . -. . -. . .. . _. -

" surface" of the trailer were greater than the 200 mR/hr limit, Vermont Yankee removed three boxes with high radiation levels and substituted three other boxes on the trailer.

On February 5,1980, the loaded trailer, which met the radiation level requirements, was taken to scales and weighed.

The trailer was overweight, so another box was removed frcm the trailer.

A radiation survey was made of the trailer loaded with the 19 wooden boxes on February 6, 1980.

The survey was at the sides of the flatbed trailer and in the cab of the trailer.

According to the licensee, the licensee did not measure the radiation levels at either the underneath surface of the flatbed trailer or the top surface of the tarpaulin cover over the boxes.

The failure to measure the radiation at the underneath surface of the trailer apparently resulted in the release of a trailer for transport with a radiation level at an external surface in excess of the Department of Transportation regulation of 200 mR/hr given in 49 CFR 173.393(j)(2).

The licensee recorded the results of the survey of the tractor-trailer on their form VYAPF 0504.02, VYNPS RADI0 ACTIVE SHIPMENT RECORD, EXCLUSIVE USE RADI0 ACTIVE MATERIAL SHIPMENT, TRUCK SURVEY.

This form showed: the radiation level in the tractor cab was <1 mR/hr; the 8 radiation readings at 6 feet from the edge of the trailer ranged from 3 to 6 mR/hr; and the 6 radiation readings at the edge of the trailer ranged from 10 to 125 mR/hr.

(See Exhibit 5. ) The licensee measured the radiation from the surface and 3 feet from the surface of each of the packages.

The licensee recorded the results of these surveys on their form VYAPF 0504.03, VERMONT YANKEE NUCLEAR POWER CORPORATION SHIPMENT DATA.

The data for the 19 boxes showed the surface radiation from the boxes to range from 12 to 150 mR/hr and the ~ radiation at 3 ft. ranged from 4 to 10 mR/hr.

(See Exhibit 6.)

The licensee did not measure the radiation from the top and bottom surfaces of the boxes, and a box, as iaeasured at the burial site, had radiation levels of about 1R/hr at both the top and bottom surfaces.

According to the data on the VYAPF 0504.03 form, the box with the 1R/hr radiations, box 16, had a maximum surface radiation reading of 60 mR/hr.

The specific instructions to the carrier for maintenance of exclusive use shipment controls were included on the VYNPS RADIOACTIVE SHIPMENT RECORD, EXCLUSIVE USE RADIOACTIVE MATERIAL SHIPMENT, TRUCK SURVEY, VYAPF 0504.02, form.

These' instructions were: " NOTE: The carrier , must not permit loading or unloading from this transport vehicle i except at the final destination."

The Tri-State Motor Transit Company tractor-trailer left the Vermont Yankee Nuclear Power Station on February 7,1980.

While the tractor-trailer was at the Tri-State Motor Transit Company terminal in Seneca, Illinois, the tractor pulling the trailer containing Vermont Yankee radioactive waste was changed.

This tractor change was made for the convenience of the drivers of the driver-owned tractors leased to and under the control of the Tri-State Motor Transit Company.

However, this change of tractors did affect the radiation in the cab of the trailer.

The tractor used from Vernon, Vermont, to Seneca, Illinois, was of the cab-over design; and the tractor used from Seneca, Illinois, to Richland, Washington, was of conventional design with the engine in front of the cab.

The tractor-trailer arrived at the NEC0 burial site on February 14, 1980. The NRC inspector at the site found radiation levels of 300 mR/hr underneath the trailer and 3 mR/hr in the sleeping compartment of the cab.

He also performed radiation surveys of the wooden boxes during trailer unloading.

He found that box number 16 had a maximum radiation level of about 1R/hr at surface areas of about one square foot on the top and bottom of the box.

Findings The radiation from the underside of the flatbed trailer as measured by the NRC inspector at the NEC0 Richland, Washington, burial site was greater than the Department of Transportation limits given in 49 CFR 173.393(j)(2).

Therefore, packages with surface readings greater than 200 millirem per hour could not be transported under the conditions of 49 CFR 173.393(j).

Instead, the packages had to meet the conditions of49CFR173.393(i). A package with radiation of 1R/hr at both the top and bottom surface was transported, and the limit for the radiation from the surface of a package given in 49 CFR 173.393(1) is 200 millirem per hour.

This is an item of noncompliance. According to the licensee, they were not measuring the radiation from the underside of the flatbed trailer or the top of the covered boxes.

They also were not measuring the radiation from the top and bottom surfaces of the boxes.

The changing of the tractors apparently caused the change in the radiation levels in the cab of the tractor. The tractor surveyed by the licensee at this facility was a cab-over design, and the tractor sunayed by the inspector at the burial site was a conventional design with the engine in front of the cabin. Tri-State Motor Transit Company authorized the change in tractors and drivers without the knowledge of the license ~ , .

Corrective Action The licensee is changing the procedures to include measuring the radiation levels from the bottom and top surfaces of the trailers and from the top and bottom surfaces of the waste containers.

The inspector suggested that the truck survey form be revised to show the radiation from the top of the trailer.

(See Exhibit 12.). The licensee changes the specific instructions to the carrier for maintenance of the exclusive use shipment controls as follows: " NOTE: The carrier must not perm.it loading, unloading or rearranging the cargo or changing the tractor or fifth wheel movement without notifying Vermont Yankee, 802-257-7711." The inspector suggested that the instructions might call for prior authorization from Vermont Yankee before any changes are made. The licensee also added a requirement for the drivers' signature on the form.

(See Exhibit 12.). 7.

Reporting of Significant Events The inspector met with the Plant Superintendent and VY staff members to discuss a Final Rule which became effective February 20, 1980 and amends 10 CFR Parts 20 and 70 regarding reporting of significant events.

The amendments to the aforementioned regulations define twelve categories of events that require prompt (within one hour) notification to the NRC Operations Center, using the dedicated phone line (hot line) established between the VY control room and the NRC Operations Center.

Each category listed in the Rule was discussed along with examples of events fitting each category.

The licensee will provide the new reporting requirements to shift personnel using the Night Orders Book starting on the 4:00 p.m. to midnight shift on February 21, 1980.

The night orders book is required reading for shift personnel.

Additionally, the reporting requirements will be incorporated in the operator training program both as a separate item and through revisions to plant procedures as they are issued.

Licensee review of the reporting requirements will begin immediately to determine which plant procedures need to be changed to incorporate / reference the reporting requirements.

The licensee expects procedure revision and training of all plant operators will be completed in about 30 days.

The inspector had no further comments in this area at the present.

Licensee action regarding procedure revisions and operator training will be examined on subsequent, inspections.

Exit Interview A management meeting was held with licensee personnel (denoted in paragraph 1) at the conclusion of the inspection on February 21, 1980.

The purpose, scope and findings of the inspection were discussed as they appear in the details of this report.

The licensee noted the apparent item of noncompliance as described in paragraph 5.

The shipment consisted of twenty large wooden boxes, each having a volume of about 83 cubic feet.

Contents of the boxes was solid LSA , waste contaminated with radionuclides of Transport Group III, accord- ' ing to the shipping papers.

The trailer was of the fistbed type. A . . . tarpaulin, tied down to the trailer. covered the tops and upper portions of the boxes, but did not prevent access to the packaRes- - The trailer is therefore considered to be an "open t ransport vehicle."

Radiation surveys were made of the loaded vehicle.

The maximum radiation level at any point six feet from the vert ical planes pro-jected from the outer edges of the open vehicle was about 9.5 mR/hr.

This is within the limit of ten mR/hr prescribed in 49 CFR 173.393(j)(3).

The maximum radiation level in any normally occupied position in the vehicle was 3 mR/hr, in the sleeping compartment of the cab. This measurement was made with a Minimonitor II (D. L. Collins and Asso-ciates) and was confirmed with a Victoreen Ion Chamber Model 470A.

This level is not in compliance with 49 CFR '73.393(j)(4) which states that the maximum permissible radiation level in any normally

, occupied position in the vehicle is 2 mR/hr.

Radiation surveys were made of the wooden boxes during trailer un-loading.

One box, identified is number 16, had a maximum radiation level of about 1 R/hr at surface areas of about one square foot on the top and bottom of the box.

This level exceeds the limit of 200 mR/hr prescribed in 49 CFR 173.393(i) and is an item of noncompliance.

In examination of the shipping papers, it was observ'ed that the information "exclu:ive use of truck and trailer" appeared on the bill of lading.

This information in considered to be insufficient to meet the requirement of 49 CFR 173.393(j), which states that specific instructions for maintenance of the exclusive use shipment controls must be provided by the shipper.to the carrier.

The absence of such instructions is considered to be an item of noncompliance. The - inclusion of more specific instructions could have prevented the noncompliance identified in Paragraph 2, in the opinion of the in-spector. The insp5ctor learned that while the shipment was in tran. sit, engine failure caused the replacement of a " cab-over-engine" type tractor with another type tractor which placed the driver closer to the load.
