ADEQUACY OF CORRECTIVE ACTION ASSOCIATED WITH SAFETY RELATED CLASSIFICATION VIOLATION (50-269/93-02, 50-270/93-02, AND 50-287/93-02)

Thank you for your responses of June 7 and July 14, 1993 to our Notice of Violation, issued on May 7, 1993, concerning activities conducted at your Oconee facilit On October 21, 1993, at a management meeting in the Region II offices in Atlanta, Georgia, your staff presented the Duke position as to why the circuit breakers in question were not QA Condition I as identified in the Oconee Quality Standards Manual. QA Condition I generally equates to safety related within the context of Appendix B to 10 CFR 50. There was agreement at this meeting that the capability of the breakers to shed the non-safety related loads was important to safet We have evaluated the information that you provided both in writing and at the meeting. We understand that the breakers in question were purchased and installed under the same controls and specifications as they would have been if they had been considered QA Condition I (safety related). Additionally, we understand that you commit to maintain and test these breakers in the future as if they had been classified as QA Condition I. However, the reason that you did not classify the breakers as QA Condition I was that control cabling for these breakers had not been installed as QA Condition I. You provided information that demonstrated there was no impact on the ability of these breakers to open (or to shed loads) because of the control cable issu We conclude that the ability of these breakers to shed loads falls under the umbrella of the Introduction to Appendix B of 10 CFR 50, in that their function to shed load (i.e., to open) is important to safety., However, we also conclude from our evaluation that your commitments will satisfy 9312010143 931115 PDR ADOCK 05000269 G
