This refers to your April 9,1987 request to Chairman Zech for an exemption froT. fees under the provisions of 10 CFR 170.11(b)(1) for General Electric's February 28, 1986 application for a revision to Certificate of Compliance No. 5942. Revision No. 12 was issued on September 4,1986, in accordance with General Electric's request.

Your letter requests that the NRC give consideration to the public a interest and not, in effect, indirectly create a charge on one Government agency for services performed by another. The public policy of 31 U.S.C. 9701 is that Federal Government agencies are not to be directly charged fees, but that private comercial persons subject to NRC licensing and regulation are to pay, to the fullest extent possible, the agencies costs of performing regulatory services. In some cases ,

Government agencies, such as TVA, pay substantial fees to NRC under Section 161w. of the Atomic Energy Act. DOE is also to reimburse NRC for NRC work on the high level waste repository program. The fact that a person like GE is performing work under contract to a Federal agency has not been considered a basis for exemption from fees. We estimate that there are at least 100 licensees providing services to Government agencies that require an NRC license and NRC inspection. In a few cases the total business of the licensee is with the Government. All these licensees pay fees, some substantial in amount. Accordingly, we do not see, or agree, that there is a public interest to be served in relieving GE of the fee at the same time it retains a comercial advantage from the issued certificate.

As indicated in our January 13, 1987 letter to Mr. Robert S. Carter, and as acknowledged in your letter, the exemption in 10 CFR 170.11(a)(5) is not applicable to the February 28, 1986 application since General Electric was the applicant and the revision was issued to General Electric. However, since the exemption in 10 CFR 170.11(a)(5) would.

have applied if the National Bureau of Standards hid elected to be the applicant and since you state in ycur letter that the cask is for the sole use of the National Bureau of Standards, the Commission will refund
