Unescorted access was granted to an individual based on information the individual provided on a personal history questionnaire. A "best effort" attempt was made to verify past employment information, but the past employer did not respond within the allowed time period. The individual was granted unescorted access from September 16, 2002 through September 24, 2002. It was then discovered on September 26, 2002 through information provided by the past employer, that the individual potentially provided false information with regard to the reason for termination of employment. His in-processing questionnaire indicated he was laid off while the previous employer indicated he was terminated due to a fitness for duty violation. On September 28, 2002, the individual confirmed he made a false statement on his personal history questionnaire. The consequence was that the individual was allowed unescorted access in the protected area. Upon discovery, the individual's access was denied, and the Personnel Access Database System (PADS) was updated. This event is reportable to the NRC in accordance with 10 CRF 73.71.

B. Description of Event:

On September 11, 2002, an individual started in-processing at Byron Station for the Unit 2 refueling outage work. As part of the screening requirements, the individual provided a 5-year personal history employment record and a negative drug Fitness for Duty (FFD) test. On September 16, 2002, the background check company utilized by Exelon Generating Company, LLC (Exelon) gave a "best effort" in attempting to contact a past employer of this individual. "Best effort" is defined as three attempts to verify the information given. The past employer did not return contact with the background check company. Since the "best effort" attempt to validate employment was satisfied, temporary unescorted access was granted to the individual. The individual worked at Byron Station from September 16, 2002 through September 24, 2002. On September 26, 2002, the past employer made contact with the background check company and advised them that the individual did not get laid off, as the individual stated on the personal history questionnaire, but was terminated based on an FFD violation. The background check company notified Exelon corporate security. Corporate security made the appropriate entries into PADS to place the individual on temporary hold and attempted to contact the individual.

On September 28, 2002, at 1345 hours0.0156 days <br />0.374 hours <br />0.00222 weeks <br />5.117725e-4 months <br />, the individual contacted corporate security and confirmed that he had falsified the information on the personal history questionnaire and had indeed been terminated based on an FFD violation from the previous (non-nuclear) employer. Upon confirmation from the individual that the information had been falsified, Corporate Security notified Byron Station at 1400 hours0.0162 days <br />0.389 hours <br />0.00231 weeks <br />5.327e-4 months <br /> on September 28, 2002.

Based on this information, the individual should not have been granted unescorted access. The event was determined to be reportable to the NRC in accordance with 10 CFR 73.71(d). The NRC Operations Center was notified at 1436 hours0.0166 days <br />0.399 hours <br />0.00237 weeks <br />5.46398e-4 months <br />. An investigation was conducted to determine the individual's work activities at Byron Station. The individual was involved in non-safety related activities such as paint removal and grinding, and these activities did not require any system breech. The individual worked as part of a crew, and was not assigned any work activities that were isolated or remote. On September 24, 2002, the individual was terminated favorably. Since the event occurred after the individual was terminated and access had been revoked, no compensatory measures were needed. It was confirmed that the individual is currently denied access. PADS has been updated to reflect the individual's current status.

Based on the criteria for unescorted access and the verification of the appropriate number of other employment records, the background check company fulfilled the requirements. The individual also completed all in processing requirements. Verification of all components of this individual's in-processing has been validated and it has been confirmed that all processing was complete and accurate based on information given by the individual.

C. Cause of Event:

The cause of this event was the information provided by the individual was intentionally falsified. The individual was in-processed correctly and granted unescorted access based on this false information. All in-processing personnel are instructed that information provided must be complete and accurate.

D. Corrective Actions:

The individual was denied unescorted access and the PADS database was updated to reflect current information.
