Reference:

Crystal River Unit 3 to NRC letter 3F1007-01, dated October 25, 2007, "Crystal River Unit 3 - License Amendment Request No. 275, Revision 0, Application for Technical Specification Change TSTF-374, Revision to ITS 5.6.2.14 and Associated Bases for Diesel Fuel Oil Using the Consolidated Line Item Improvement Process"

Dear Sir:

Florida Power Corporation (FPC), doing business as Progress Energy Florida, Inc., hereby withdraws License Amendment Request (LAR) No. 275 in its entirety. The proposed LAR (Reference) was submitted to modify the Crystal River Unit 3 (CR-3) Improved Technical Specification (ITS) by relocating references to specific American Society for Testing and Materials (ASTM) standards for fuel oil testing to licensee-controlled documents. Technical Specification Task Force (TSTF) traveler TSTF-374 was used to prepare this LAR, with deviations.

On July 29, 2008, a telephone conversation was held between the Nuclear Regulatory Commission (NRC) Project Manager, NRC technical reviewers, and CR-3 Licensing and Chemistry personnel concerning the deviations that CR-3 had taken to TSTF-374. CR-3 personnel concluded that justification acceptable to the NRC could not be provided for some of the deviations taken (e.g., 31 day testing requirement, per TSTF-374, versus the current 92 day testing requirement). Subsequently, the decision was made to no longer pursue NRC approval of the referenced LAR.
