CRYSTAL RIVER NUCLEAR PLANT, UNIT NO.3 - WITHDRAWAL OF LICENSE AMENDMENT REQUEST (LAR) NO. 275, REVISION 0, REGARDING THE ADOPTION OF TECHNICAL SPECIFICATION TASK FORCE (TSTF) TRAVELELER TSTF-374, (TAC NO. MD7251)

Dear Mr. Young:

By letter dated October 25, 2007, Florida Power Corporation (FPC) applied for an amendment to the Crystal River Nuclear Plant, Unit No.3 (CR-3), Facility Operating License No. DPR-72, and its technical specifications. The proposed change would have modified the facility Improved TS 5.6.2.14 by relocating references to specific American Society for Testing and Materials standards for fuel oil testing to licensee-controlled documents using TSTF-374.

On JUly 29, 2008, a telephone conversation was held between the Nuclear Regulatory Commission (NRC) staff and FPC personnel concerning CR-3's proposed deviations from TSTF-374. The licensee concluded that justification acceptable to the NRC could not be provided for some of the proposed deviations. Subsequently, the licensee withdrew the subject LAR by letter dated August 26, 2008.

The NRC has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication. Please contact me at (301) 415-1447, if you have questions.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION FLORIDA POWER CORPORATION DOCKET NO. 50-302 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (NRC, the Commission) has granted the request of Florida Power Corporation (the licensee) to withdraw its October 25, 2007, application for proposed amendment to Facility Operating License No. DPR-72 for the Crystal River Unit 3 Nuclear Generating Plant (CR-3) located in Citrus County, Florida.

The proposed amendment would have revised the CR-3 Technical Specifications to impose more restrictive voltage and frequency limits during surveillance testing of the emergency diesel generators.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on January 29, 2008 (73 FR 5223).

However, by letter dated August 26,2008, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated October 25,2007, and the licensee's letter dated August 26,2008, which withdrew the application for license amendment.
