Report of Investigation Pursuant to 10 CFR 20, Appendix G Crystal River 3 Nuclear Power Station Docket Numbers 50-302 License Number DPR-72

Dear Sir,

This letter documents the results of an investigation performed with respect to the transportation of 2 shipments in rail cars containing UN3321 LSA-II materials and 3 shipments in rail cars containing EXEMPT materials which exceeded the 45 day time limit for notification of receipt from the disposal facility as specified in 10 CFR Part 20, Appendix G, as exempted. The investigation, which was completed on February 6, 2024, determined that the railroad logistics contractor, I.C.E Service Group, traced the shipments on a daily basis. The disposal facility, Waste Control Specialists (WCS), and the Crystal River 3 waste operations personnel received daily updates fro m the various carriers such as Florida Northern Railroad (FNR), CSX Transportation (CSXT), Texas-New Mexico Railroad (TXN), and Union Pacific (UP).

10 CFR 20, Appendix G, Requirements for Transfers of Low-Level Radioactive Waste Intended for Disposal at Licensed Land Disposal Facilities and Manifests,Section III.A(9) states for any shipments or any part of a shipment for which acknowledgment of receipt has not been received within the times set forth in this appendix, conduct an investigation in accordance with Section III.E of this appendix.

Section III.E states that any shipment or part of shipment for which acknowledgement is not received within the times set forth in this section must:

1. Be investigated by the shipper if the shipper has not received notification or receipt within 20 days after transfer (45 days in accordance with the current exception for CR3 per ML21028A590); and
2. Be traced and reported. The investigation shall include tracing the shipment and filing a report with the nearest Commission Regional Office listed in Appendix D to this part.

Each licensee who conducts a trace investigation shall file a written report with the appropriate NRC Regional Office within 2 weeks of completion of the investigation.

On September 29, 2023, 1 shipment in a rail car containing radioactive material, UN3321 LSA-II along with 3 shipments in rail cars containing EXEMPT material departed from the Crystal River 3 site at 15760 West Power Line Street in Crystal River, Florida to Waste Control Specialists, LLC in Andrews Texas. Additionally, on November 17, 2023, 1 shipment in a rail car containing radioactive material, UN3321 LSA-II departed from Crystal River 3 to Waste Control Specialists, LLC in Andrews, Texas.

Crystal River 3 and Waste Control Specialists, LLC received daily tracking reports from the railroad logistics contractor, I.C.E. Service Group, for all waste shipments transported by rail from the Crystal River 3 Site. The location s of the subject shipments were verified and traced until receipt at the destination facility. Crystal River 3 and Waste Control Specialists, LLC tracked the progress of the shipment through the daily trace reports. At no time were the shipments lost or in an unknown location. The shipments were placed at the disposal facility by the rail carrier in October and December 2023 respectively. Disposal facility equipment challenges and staffing availability, due to the holidays intermission, attributed to the delay in receipt.

The rail cars were released to the first railroad carrier (Florida Northern Railroad) on the dates identified above. After release in September from the Crystal River 3 site, rail car ITFX 81 21, was in transport for 111 days before the shipment was received at the disposal facility on 1/18/2024. Rail cars SOXX 526855, SOXX 526894, and SOXX 526897 was in transport for 130 days before the shipments were received at the disposal facility on 2/6/2024. After release in November from Crystal River 3 site, rail car ITFX 8110 was in transport for 70 days before the shipment was received at the disposal facility on 1/26/2024.

Below is the summary for the rail shipments that exceeded the time provided in 10 CFR 20, Appendix G (as exempted). The summary includes the shipment identification (manifest) numbers, rail car identification (ID) numbers, shipment dates, date of receipt at the waste disposal facility, and the total number of days the shipments were in transit.
