ZION NUCLEAR POWER STATION, UNITS 1 AND 2 - REQUEST FOR EXEMPTION FROM CERTAIN REQUIREMENTS OF THE FINAL RULE FOR ENHANCEMENTS TO EMERGENCY PREPAREDNESS REGULATIONS (TAC NOS. J00439 AND J00440)

Dear Mr. Sauger:

By application dated June 20, 2012, Zion Solutions, LLC, submitted a request for exemption, "Request for Exemption to Revised Emergency Planning Rule" (ADAMS Accession No.

ML12173A316), from specific emergency planning requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 50 for the Zion Nuclear Power Station (ZNPS).

Pursuant to 10 CFR 50.12, the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements of 10 CFR Part 50 when (1) the exemptions are authorized by law, will not present an undue risk to public health or safety, and are consistent with the common defense and security; and (2) when special circumstances are present.

The enclosed exemption Federal Register notice concludes that certain of ZionSolutions's requested exemptions are authorized by law, will not endanger life or property or the common defense and security, and are otherwise in the public interest, and that special circumstances are present based on the reduced radiological risk to the public from an Independent Spent Fuel Storage Installation at a permanently shut down, defueled reactor. Accordingly, pursuant to 10 CFR 50.12, as specified in the enclosed notice, certain exemption requests are granted and effective immediately. The exemption will be published in the Federal Register.

Other requirements from which you requested exemptions were determined to either be not applicable to your facility or are being met by your current program or an exemption was not appropriate, therefore, an exemption was not necessary or was denied for those requirements.

The enclosed U.S. Nuclear Regulatory Commission (NRC) staff Safety Evaluation Report articulates the basis for granting your specific exemption requests or determining that the requests were not necessary.

Pursuant to 10 CFR 51.21, 51.32, and 51.35, an environmental assessment and finding of no significant impact was published in the Federal Register. Based upon the environmental assessment, the Commission has determined that issuance of this exemption will not have a significant effect on the quality of the human environment.

In accordance with 10 CFR 2.390 of the NRC's Rules of Practice and Procedure, a copy of this letter will be available electronically for public in spection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agency-wide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site in the NRC Library at http://www.nrc.gov/reading-rm/adams.html.
