Dear Administrative Judges:

On May 5, 2015, FPL provided a letter with its u nderstanding of the schedul es for certain related state administrative proceedings and best estimates of the timeframe fo r expected decisions. Since that time, a number of developments have occurred that may be of interest to the Board. First, the South Florida Water Management District issued an Emergency Order on May 19, 2015, which allows the withdrawal of water fr om the L-31 E canal during the pendency of the administrative challenge to the consumptive use permit, subject to certain conditions. Subsequently, the U.S. Army Corps of Engineers and Miami-Dade County issued wetland permits necessary to install pipe for the L-31 E w ithdrawals on May 22 and June 1, respectively.

The L-31 E authorization only allows withdrawals if a certain level of water is available in the canal. To date, no water has been withdrawn from the L-31 E canal due to insufficient rainfall. Second, a joint motion for continuance of the scheduled hearing was filed yesterday by the parties in each of two relevant administrative hearings. These include the challenge to the modification of the Conditions of Certification for Turkey Point Units 3-5 to allow Upper Floridan Aquifer wells and the challenge to the Administrative Order that would require FPL to submit a Salinity Management Plan. In both cases, all parties agreed to a 12-week continuance AdministrativeJudgesGibson,KennedyandSagerJune25,2015Page2of2to allow time and opportunity to at tempt to resolve the issues in dispute. The Administrative Judge today granted the continuances in both cases. FPL will continue to inform the Board of significant developments in these cases.
