Docket Nos. 50-250-SLR and 50-251-SLR July 15, 2019 NOTICE REGARDING DISMISSAL OF CONTENTIONS In accordance with its obligation to inform the Commission of relevant developments,1 Florida Power & Light Company (FPL) hereby provides notice that all contentions in the above-captioned proceeding have been dismissed. In LBP-19-3, the Atomic Safety and Licensing Board (ASLB) admitted portions of two contentions proffered by Friends of the Earth, Inc., Natural Resources Defense Council, Inc., and Miami Waterkeeper, Inc. (collectively, Joint Intervenors).2 FPL appealed that decision to the Commission.3 Thereafter, following the NRC Staffs issuance of the Draft Supplemental Environmental Impact Statement (DSEIS), FPL moved the ASLB to dismiss those two contentions as moot, based on new information in the DSEIS. On July 8, 2019, the ASLB granted FPLs motion and dismissed Joint Intervenors contentions 1-E and 5-E.4 Thus, FPLs appeal seeking Commission 1

(Mar. 7, 2019). The ASLB also admitted, in part, two contentions proffered by Southern Alliance for Clean Energy (SACE). However, SACE subsequently withdrew from the proceeding, and its admitted contentions were extinguished. See Notice Regarding SACE Withdrawal (Apr. 11, 2019) (ML19101A296).
